                                                    TERMS AND CONDITIONS-CONTRACT  

     
American Baggage and Box Transport, Inc. ('American Baggage'), is a freight forwarding company specializing in the movement of boxed or crated personal effects and commercial products on a worldwide basis. 

PAID INSURANCE COVERAGE
Limited liability insurance is available for protection against loss, damage and or pilferage at a cost of 3.3% of the packing list declared value, minimum $30.   Insurance must be requested in writing prior to pick up of the goods. This insurance is subject to exclusions and limitations per our open cover marine policy. This insurance will protect you for loss or damage as noted on our web site at http://www.discount-shipping.net/pdf/Ack_Ocean_or_Air_PE_Owner_All_Risks_300_Deductible.pdf. Insurance claims by a client must be processed thru the designated marine insurance company and not thru American Baggage & Box Transport,Inc.  Any damage or missing goods received at destination must be noted on the consignee sign off sheet at the time the consignee or his designated agent takes possession of the shipment.  This is for your protection. 
Free insurance coverage is offered by the steamship lines and airlines however we recommend purchasing private insurance coverage.  In the event you have a insurance claim and did not pay for private insurance coverage offered by American Baggage & Box Inc., then claims  must be made directly with the steamship line or airline and not through American Baggage & Box Transport, Inc..   

STORAGE
There is no free storage time.  Any shipment not prepaid or any shipment with insufficient documentation can be charged substantial storage charges determined by American Baggage & Box Transport, Inc., the transport carrier and or fines by Customs Officials.
Any shipment received at destination country terminal not recovered by the receiving client within three days of its arrival, maybe considered abandoned unless the shipper or receiver notifies us in writing in advance of delays in recovering the shipment. 
Storage charges, customs penalties or disposal costs will automatically be debited to the shipping clients credit card or billed back to the shipper. By acknowledging this agreement, the shipping client agrees that we have the expressed authority to debit their credit card for any costs involved in the abandonment of their shipment.

TRANSIT TIME
We make every effort to have the shipment arrive at its destination on time, however, we do not guarantee a specific transit time and no deduction in shipping costs will be allowed unless agreed to in writing by American Baggage & Box Transport, Inc..

DOCUMENTATION
Export documentation must be completed and sent to American Baggage and Box Transport, Inc., no later than one day after shipment is dropped off to us or picked up by us.  Failure to complete the documentation required by American Baggage and Box Transport, Inc., in writing, will result in delay and or storage charges and or other penalties. 
American Baggage & Box Transport, Inc., is not responsible for handling the import custom clearance process at destination unless agreed to in writing. Whether or not American Baggage & Box Transport, Inc., or it's agents handle the formality of the custom clearance, it is still the responsibility of the receiving client to have the proper documentation prepared so that the  import custom clearance can take place. Therefor
the receiving client must be aware of the laws, requirements and restrictions of that country and prepare any necessary documentation needed for custom clearance. This is not the responsibility of American Baggage & Box Transport, Inc., or its representatives at the destination country.

RATES AND SERVICES:
To eliminate any mis-understandings, no verbal shipping quote or agreement should be accepted by you.  American Baggage & Box Transport, Inc.,  will not honor a verbal rate,verbal quote, verbal  request for special service or any perceived promise. All rates, tariffs, services are published on our web site or will be provided to you in a written form.  All services, all commitments and all promises will be in writing to you and honored.

COMMUNICATION:
It is your responsibility to provide on the packing list a telephone and email address where the shipper and receiver [consignee] can be contacted. Failure to do so can result storage charges, customs fines and other difficulties.

DESTINATION AND ORIGIN CHARGES
All international shipments are subject to destination fees,duty, tax, VAT, terminal fees, unloading fees, unstuffing fees and or other fees, which are beyond our control. These charges vary according to destination country and are accepted practices in the destination shipping industry. The consignee must clear their shipment through customs at the designated port of entry assigned by the steamship line representative.  American Baggage & Box Transport,Inc., is not responsible to arrange custom clearance for any shipment unless agreed to in writing.  Because of tight security, export or import customs offices of that country  may require your shipment to be inspected and there could be charges related to such action. These charges will be billed to the shipper or receiver of the goods and are not part of a normal process of custom clearance procedures.  Irregardless of who implements the custom clearance, it is the shipper and or receivers responsibility to meet the obligations and laws of cargo entry to that country. 
 Exports from countries other than the US or Canada, shippers are subject to various export charges and fees depending on the country of export and any such related charges are added to the clients invoice of charges.
Imports to USA or Canada:  Estimated terminal and warehouse charges are invoiced to the client [receiver]. The client [receiver] is responsible for any such charges that exceed the estimate provided.

SHIPPING VEHICLES
All vehicles being shipped must have the original title, certified copy, or MSO and the dock receipt to be presented to US Customs for export release. Documents should be sent to us via overnight courier and in turn, we will send the documents to US Customs by overnight courier. No vehicle or container with a vehicle inside can be exported without US Customs approval. American Baggage & Box Transport,Inc., will make every reasonable effort to secure the approval from US Customs however we are not responsible for any storage charges by the steamship line or customs penalties by US Customs in the event that documents are delayed, missing or in any way not acceptable to US Customs. 

PAYMENT
Payment terms have already been provided to you in writing. All shipments are on a prepaid basis and full payment is due us upon
presentation of invoice. If you did not receive a invoice within two days of dropping off your shipment or pick up of your shipment, it is your responsibility to contact us concerning your payment.

By acknowledging this document via email, I agree to the terms and conditions as contract for shipping service.
